Terms and Conditions of Booking

 

The Provider – PLE Photobooth
The Customer – The person or company booking the PLE Photobooth for their event

 

The following contract and its terms will set forth an agreement between the Provider and the customer for the hire of the Photobooth. This written contract sets forth the full, written intention of both parties and supersedes
all other written and/or oral agreements between the parties.

 

Payment 
A non-returnable deposit of £100 is required to secure a reservation for the Photobooth, the balance of the agreed rental charge is due 7 days before the Customer’s event. If the Customer uses the equipment for a period in excess of the agreed service period additional rental charges will be payable by the Customer to the Provider, calculated on a pro rata basis. If the operator requires an extension of rental time payment is required in advance of this new rental period. Idle hours are charged at the rate of £40 per hour.

 

Date changes and cancellations
Any request for a date or venue change must be made in writing at least thirty days (30 days) in advance of the original event date. Change is subject to Photobooth availability and receipt of a new booking agreement. If there is no availability for the alternate date, the deposit shall be forfeited and the event cancelled.
If the customer requests a cancellation they will forfeit any deposit payment made.
Your deposit is non-refundable however we will move your hire date if possible.
Your final payment is non-refundable unless the Provider does not provide a Photobooth hire for you.

 

Loss or damage to Provider’s Equipment
The Customer assumes complete responsibility for any loss of or damage to the Provider’s equipment (other than fair wear and tear) caused by any misuse of the equipment by the Customer, their employees or their guests
The Customer shall be responsible for any loss of or damage to the Provider’s equipment caused by Theft , Fire, Flood or Accidental Damage.

 

Indemnification
The Customer agrees to, and understands the following:
a) The Customer will indemnify the Provider against any and all liability related to the Customer’s Event and use of

    the Provider’s equipment .
b) The Customer will indemnify the Provider against any and all liability associated with the use of any pictures

    taken at the Customer’s event by the Photobooth or by its operatives , employees or affiliates.


The Customer agrees to, and understands the following:
All persons using the Photobooth at the Customer’s Event hereby give the Provider the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any Photobooth user who may be included in whole or in part, via any or all media now or hereafter known for illustration, art, promotion, advertising, trade, or for any other purpose.
In addition the Customer , hereby releases, discharges and agrees to maintain the Provider free from any liability arising out of the taking of said picture or any subsequent processing or publication thereof including, without limitation, any claims for libel or invasion of privacy.

 

Access, space required and power requirements
The Provider will arrive at least one hours prior to an event to set up and test the Photobooth correctly. The customer should ensure that all appropriate consents and approvals have been obtained to ensure that the Provider has the permitted access to install the Photobooth at the requested location - The Photobooth must be located in an inside area deemed safe by the Provider and having an adequate, safe and nearby 13amp power supply. The Provider cannot be held responsible if for any of the above reasons we cannot deliver the Photobooth on time for your event and will not be liable to extend the hire time.

If the Photobooth requires an internet connection for it’s social media features, which shall be your responsibility to provide. The speed of connection will be dependent upon the service Provider and we cannot be held liable for any delays in connection or connection failures as a result of using a 3G.

 

Staffing of the Photobooth
The Provider will not tolerate any abuse or threatening behaviour to any of it’s staff or abuse of the Photobooth or equipment. If this occurs the Provider retain the right to terminate the hire immediately.
This applies equally to you and your guests. The Provider may terminate the hire in cases where our staff are of the reasonable view that the equipment including the Photobooth itself belonging to The Provider is in danger of being damaged or has been damaged due to the actions or unruly behaviour of the people using the Photobooth(s). We will tolerate unruly behavior to an extent and liaise with the customer or venue first to try to resolve the matter before any termination is enacted. If we do terminate, for any reason, the full hire charge will remain due and we will not issue any refunds for any period of hire not provided.

 

Photobooth Operation
In the unlikely event that it is not possible, other than for reasons beyond the Provider’s control, to provide an operational Photobooth for at least 80% of the agreed service period, the Provider shall make a refund to the Customer calculated pro rata from the total charge made for the agreed service period.
Where the rental includes a photographic printer and for any reason printed photographs cannot be provided on site at the time of the event, the Provider will print off all of the photographs, as soon as possible, from the event and deliver by post, free of charge to the customer.
If no service is received, the Provider’s maximum liability will be the return of all payments received from the Customer. The Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.

 

Limitation of Liability
We disclaim any and all liability to you for the supply of the Photobooth to the fullest extent permissible under applicable law. This does not affect your statutory rights as a consumer. If we are found liable for any unforeseen cancellation, loss or damage to you, such liability is limited to the hire charge you have paid. We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising.
We shall not be held liable for any failure or delay in performing the service and hiring the Photobooth where such failure arises as a result of a Force Majeure event. In such circumstances our liability shall be limited to a pro rata refund of the deposit where applicable.
We do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the hire of the Photobooth. We do not make any representation or guarantee that use of the Photobooth in any promotional context will generate revenue or customers for you or your business.
We shall not be liable for any misrepresentations other than fraudulent misrepresentations.
Nothing in this Hire Agreement shall limit our liability for personal injury or death arising as a direct result of our negligence.
